Terms of Service

These terms govern an organization's use of Beehave. For student education records, the organization's signed data privacy agreement with Instupituous, LLC (the California Student Data Privacy Agreement, or an equivalent) controls; where these terms and that agreement differ, the agreement wins.

1. The service

Beehave is a web application for recording and reporting students' behavior data, assessments and behavior intervention plans, offered to school districts and to the agencies those districts contract. Accounts are created by invitation from an organization's administrator; there is no public sign-up.

2. Student data

  • Student records remain the property of, and under the control of, the school district.
  • We use student data only to provide the service to that district and never for any other purpose.
  • We do not use student data to advertise or market to students or their parents, do not mine it, do not sell it, and do not use it to train or develop an artificial-intelligence model.
  • We collect only the data necessary to provide the service.
  • We will not change the terms under which we hold a district's student data without advance written notice to, and the agreement of, that district.
  • At the end of the agreement we return the district's data in a usable form on request and delete it, and certify the deletion.

3. Your obligations

  • Invite only people who are your staff or your contracted agency's staff, and give each the role their job needs.
  • Keep sign-in credentials private; tell us promptly if an account may be compromised.
  • Do not enter information you are not authorized to hold, and do not attempt to reach records outside your organization.
  • Turn AI features on only after your district has given the written consent its agreement requires.

4. Availability, support and changes

We aim for the service to be available continuously and will tell you about planned maintenance. We may improve the service over time; we will not remove a capability an active agreement depends on without notice.

5. Fees

Fees are set by written quote per district or agency, per year. Pilot arrangements are governed by the signed pilot agreement shown at invitation.

6. Liability and law

Our liability to an organization is governed by its agreement with us. These terms are governed by California law. We carry cyber liability and general liability insurance; certificates are available to a contracting district on request.

7. Privacy

Our Privacy Policy describes what we hold and why; our Security & trust page describes how it is protected; our subprocessor list names every service provider.
